The matter is listed today for consideration on admission and stay. Learned trial Court vide judgment and decree dated 28.10.2022 in Civil Suit No.18-A/2019 dismissed the suit. Learned First Appellate Court in Civil

Appeal No.87/2022 vide judgment and decree dated 31.7.2023 remanded the case to the trial Court as per paragraph 21 of the judgment.

Learned counsel for the appellant prays for grant of stay or for "Passing Over" the matter on the ground that senior will argue on stay. At this stage prayer for "Pass Over" of matter and stay is refused as there is no urgency because before the trial Court the case is not for passing of judgment.

Heard on admission. The matter is admitted for final hearing. On payment of process fee by RAD mode within seven working days, let notice of this appeal as also on stay application be issued to the respondents.

Notices be made returnable within four weeks.
