Heard on the question of admission. This second appeal under Section 100 of the Code of Civil Procedure,

1908 has been filed against the judgment and decree dated 12/05/2023 passed by 1st District Judge, Dabra, District- Gwalior (M.P.) in Civil Appeal No.19/2023 arising out of the judgment and decree dated 29/11/2022 passed by 2nd Civil Judge, Senior Division, Dabra, District - Gwalior (M.P.) in Civil Suit No.45A/2018.

The appeal involves and is admitted on the following substantial question of law;

"1.Whether, both the court below committed error of law in dismissing the suit of appellant and perverse finding recorded without considering the material documents Ex.P-1 to P/26 submitted by the appellant before the trial Court and same is not controverted by the defendant in such circumstances the judgment and decree passed by the court below is sustainable in the eyes of law ?"

Meanwhile, parties are directed to maintain status quo regarding suit property till next date of hearing.
