Heard on admission.
The present petition has been filed under Article 227 of the Constitution
of India being aggrieved by the order dated 27.10.2023, whereby application
under Section 10 of CPC preferred by the present petitioner-defendant has been
rejected.
After perusal of the judgment dated 06.03.2000 (Annexure P/5) passed in
earlier suit and copy of the plaint Annexure P/1 of the present suit, I find that
petitioner has made out a case for grant of interim relief.
Issue notice to the respondents on payment of process fee within seven
days by RAD mode.
Till the next date of hearing further proceedings of Civil Suit No. 138- A/2015 pending before the trial court, shall remain stayed.
List thereafter.
