Aggrieved by the order dated 27.04.2023 passed by the learned Single Judge in dismissing the Writ Petition No.8235 of 2022, the writ petitioner is in

appeal.

The learned Single Judge distinguished the Division Bench judgment of this Court in the case of Amjad Gani Vs. State of M.P. and others reported in 2019(1) MPLJ, 38 on various grounds.

Under these circumstances, we are of the view that the matter requires reconsideration.

Admit.

Stay of order of suspension dated 15.03.2022 passed by the OSD - cum

- Commissioner, Urban Administration and Development Department, Bhopal.

Respondents are at liberty to file an application seeking vacation/modification of this interim order.
