(1) Heard on I.A. No. 5892/2023, which is second bail application under Section 389 of Cr.P.C. for temporary suspension of sentence and grant of bail
on behalf of appellant-Bankat.
(2) The present appeal is filed against the judgment dated 29.11.2022 passed by the II Additional Sessions Judge, Jaora, Ratlam whereby the appellant has been convicted for the offence under Section 302 of I.P.C. and sentenced to undergo for life imprisonment with fine of Rs.5,000/- in default stipulation and under Section 376 of I.P.C. and sentenced to undergo for ten years R.I. with fine of Rs.2,000/- in default stipulation.
(3) No case is made out for temporary suspension as he is resident of Pratapgarh (Rajasthan) and marriage is scheduled at Pratapgarh (Rajasthan).
There are other family members available to perform religious customs and arrangement of marriage.
In view of above, I.A. No. 5892/2023 is dismissed.
