Heard on the question of admission and interim relief. Learned counsel for the petitioner submits that the remedy of respondent No.1 for execution of the judgment and decree passed by the Civil Court is for
filing execution proceedings before the Civil Court itself and for execution of that decree proceedings under Section 250 of M.P. Land Revenue Code, 1959 would not be maintainable but overlooking that aspect the impugned order dated 14.02.2023 has been passed by the Sub Divisional Officer (Revenue), District Khargone.
Considering the aforesaid, issue notice to respondent No.1 only on payment of process fee by RAD within a period of 7 working days.
Notices be made returnable within a period of six weeks. Till next date of hearing, the operation of the impugned order dated
14.02.2023 (Annexure P/1) shall remain stayed.
