Heard on IA.No.18000/2022, which is an application under Section 389(1) Cr.P.C. for grant of temporary suspension of sentence filed on behalf of sole appellant - Rahul Joshi on the ground of ill health of his mother.
Appellant stands convicted under section 450 of IPC and sentenced to undergo R.I. for three years with with fine of Rs.1000/- and under Section 376(1) of IPC r/W 3(2)(V) of SC/ST Act and sentenced to suffer Life Imprisonment with fine of Rs.5,000/- with default stipulations vide judgment dated 20/12/2018 passed by First Additional Sessions Judge, Ashoknagar in S.T. No.55/2021.
Upon consideration of submissions advanced by learned counsel for parties and regard being had to the gravity of offence, this Court is of the view that no ground is made out for temporary suspension of sentence and grant of
bail to the appellant.
Accordingly, IA.No.18000/2022 stands dismissed.
