Learned counsel for the respondent raises preliminary objection regarding
maintainability of the petition in view of judgment passed by the Apex Court in the case of Radhe Shyam and Anor Vs. Chhabi Nath and Ors reported in (2015) 5 SCC 423. Relying on the said judgment, he submits that the petition under Article 227 of the Constitution of India is not maintainble against the order passed by Quasi-Judicial Authority.
Learned counsel for the petitioner prays for and is granted time to argue the matter on the question of maintainability of the petition.
