                                   This appeal filed by plaintiff is directed against confirming the judgment
  and decree dated 14.07.2022, whereby plaintiff's suit for specific performance
  of agreement has been dismissed as not maintainable, whereas defendants'
  counter-claim for eviction has been decreed.

                                   Mr. R.K. Upadhyay - learned counsel for the appellant/plaintiff at the
  outset fairly submits that he does not intend to prosecute this appeal on
  admission and prays for indulgence to grant some time for evicting the suit
  premises.
                                   In the fitness of thing, it shall be expedient to notice only for the limited
  purpose, as regards period of time which may be granted to the plaintiff to
  vacate the suit premises.
                                   Accordingly, issue notice to the respondents on payment of process fee

within three working days.

Notice be made returnable within two weeks.
