IN THE HIGH COURT OF MADHYA PRADESH AT INDORE WA No. 1232 of 2019 (PUBLIC HEALTH ENGINEERING DEPARTMENT AND OTHERS Vs DASHRATH)

Dated : 19-01-2023 Shri Piyush Jain, learned counsel for the appellant.

The Registry has raised an objection with regard to maintainability of the appeal against the order of learned Single Judge passed in Misc.Petition against the order of Labour Court.

In view of the Full Bench decision of this Court in the case of

Shailendra Kumar Vs. Divisional Forest Officer and another, 2017(4) MPLJ 109, the intra appeal would lie against the order of writ Court arising out of the order passed by Labour Court or Industrial Tribunal.

In view of the Full Bench judgment, the office objection is overruled. Learned counsel for the appellant prays for and is granted a week's time to argue on the question of admission.
