Learned Senior Advocate Shri Anoop Choudhary submits that the issue

raised herein is no more res integra in view of decision of this Court reported in (1996) 29 VKN 162 (Commissioner of Sales Tax, Madhya Pradesh vs. Filterco, Neemuch), Division Bench order dated 1st September, 2017 passed in W.P. No.1031-1032 of 2015 ( Jamna Auto Industries Ltd. vs. State of M.P. and others) and the judgment reported in 2005 (3) MPHT 399 (Eisher Motors Ltd. and others vs. State of M.P. and others).

Let the case be taken up on 22nd February, 2023 with understanding that no further adjournment will be sought by or granted to the State to argue the matter.

Interim relief, if any, shall continue till next date of hearing.
