The appellant has been produced from Central Jail, Bhopal. Heard on I.A. No.1642/2023, which is third application for suspension

of sentence and grant of bail to the appellant. First application was dismissed on merit vide order dated 30.8.2022 and second application was dismissed vide order dated 16.11.2022 as there was no change in the circumstances.

The appellant has been convicted by the impugned judgment passed by trial Court under Sections 193, 406, 409, 420, 466, 467 and 468 of the IPC and sentenced to undergo R.I. for 3 years with fine of Rs.1,000/-, R.I. for 1 year with fine of Rs.200/- and R.I. for 5 years with fine of Rs.2,000/- for offences under Sections 409, 420, 466, 467 and 468 of IPC. respectively with default stipulations.

This third application has been filed by the appellant challenging the findings recorded by the trial Court in Paragraphs 37, 40, 41, 42 and 43 of the impugned judgment, which has already been taken into consideration by this Court while deciding earlier applications on merit. The appellant is unable to point out any change in the circumstances after dismissal of the earlier applications on merit, hence I am not inclined to entertain this repeat Signature Not Verified SAN

An application has been filed by the appellant under Section 267 of

Cr.P.C. to argue the matter through video conferencing.

For the reasons mentioned in the application, it is allowed. The appellant is permitted to argue the case through video conferencing.
