Heard on I.A.No.1097/2023 which is second (repeat) application under Section 389 (1) of Cr.P.C. for suspension of sentence and grant of bail filed on behalf of appellant - Ganesh Kevat. First application was dismissed as
withdrawn.
The appellant has been convicted for the offence punishable under Section 307 of IPC and sentenced to undergo 7 years, R.I., with fine of Rs. 5,000/- with default stipulation vide judgment dated 10.05.2022 passed by Additional District Judge, Badnagar, District Ujjain in S.T. No.83/2017.
As per the prosecution story, this appellant as inflicted the injury by means of knife on the chest of the injured and as per the report the injury was dangerous to life. Injury was caused on a vital part of the body, therefore, he has been convicted under Section 307 of IPC.
Within a year of conviction this is second repeat application without their being any change in circumstances, therefore, I am not inclined to grant bail.
In view of the aforesaid, this second repeat application (I.A.No.1097/2023) stands dismissed.
