Heard on IA No.15882/2022, which is an application for stay of compensation awarded by the trial court.

The appellant has been convicted under section 406 of the IPC and sentenced to undergo three years RI with fine and usual default stipulations. The appeal has already been admitted and the jail sentence of the appellant has been suspended by order dated 18.11.2022.

Learned counsel for the appellant submits that as per para 57 of the impugned judgment, the appellant has been directed to pay the amount of Rs.2,95,000/- with 10% interest with effect from 01.01.2014 in the account of Dugdah Samiti, Kamlapur. It is submitted that the financial condition of the appellant is stringent and he is not in a position to deposit the entire amount with

interest. According to him, the total amount with interest comes to about Rs.5,00,000/-. He prays for stay of the directions contained in para 57 of the impugned judgment.

After hearing learned counsel for the parties, it is directed that on deposit of Rs.2,95,000/-, the direction contained in para 57 of the impugned judgment shall remain stayed. This order is subject to deposit of the amount of Rs.2,95,000/- before the trial Court. on the application of Dugdah Samiti, Kamlapur on furnishing a solvent surety to the satisfaction of the trial Court and obtaining an undertaking from the Dugdha Samiti that in case if the appeal filed by the appellant is allowed, the said amount shall be returned to the Court.

With the aforesaid, IA No.15882/2022 stands disposed off.
