Heard on I.A. No.20684/2022 which is the fourth application filed under

Section 389(1) of the Code of Criminal Procedure on behalf of the appellant for suspension of sentence and grant of bail to appellant.

Earlier application filed by appellant for suspension of sentence and grant of bail was dismissed as withdrawn.

Vide the impugned judgment dated 28.04.2017 passed by the 4th Additional Sessions Judge, Bhopal in S.T. No.38/2013, the appellant has been convicted for offence punishable under Section 302, 307/34 and 307 of Indian Penal Code and sentenced to undergo Life Imprisonment, R.I. for 10 years and R.I for 7 years with fine of Rs.3,000/-, 2000/- and 1000/- respectively with

default stipulations.

Learned counsel appearing for appellant prayed for suspension of sentence and grant of bail on ground of incarceration of appellant for long period.

Application for suspension of sentence of co-accused person has already been considered on said ground and has been dismissed. Case of appellant is similar to that of other co-appellant and there is no distinguishable features. Appellant is also having criminal antecedents and crime committed by appellant

along with other co-appellant in day time using dangerous weapons and a professional crime.

Considering the aforesaid circumstances, I.A. No.20684/2022 filed by appellant is dismissed.
