Learned Seventh Additional District Judge, Satna in R.C.A.No.42A/14 by

judgment and decree dated 05.10.2015 affirmed the decree of rejection by the learned Civil Judge in Civil Suit No. 347A/09 vide judgment and decree dated 12.10.2012.

The appeal is admitted on the following substantial question of law :-

"Whether under the facts and circumstances of the case and material available on record, the learned Court below has erred in finding that the suit is barred by limitation ?" Learned counsel for the parties agree that on disputed land, possession is of respondents No.1 and 2 and also in the revenue record names of respondents No. 1 and 2 are there.

Let the case be listed for final hearing in due course.
