Heard on I.A. No.15515 of 2023, sixth application under Section 389 (1) Cr.P.C. filed on behalf of appellant seeking interim suspension of sentence on the ground of sad demise of his son Jaikishan Jatav.

Appellant stands convicted under Section 302 of IPC and sentenced to

undergo Life Imprisonment with fine of R s . 1000/-, v i d e judgment of conviction and order of sentence dated 30-10-2017 passed by IXth Additional Sessions Judge, District-Gwalior in ST No.466/2015.

Learned counsel for appellant submits that son of the appellant died on 17.08.2023 and he has to perform post-death rituals of his son, hence, prayer is made for interim suspension of sentence and grant of bail to the appellant.

Learned counsel for the State has verified the factum of death of son of appellant.

Taking into consideration the facts and circumstances of the case,

appellant is granted interim suspension of jail sentence to perform post-death rituals of his son. It is directed that the jail sentence of appellant shall remain suspended temporarily from 26-08-2023 to 03-09-2023. Accordingly, he be released on temporary bail subject to his furnishing a personal bond in the sum of Rs.1,00,000/- (Rupees One Lakh only) with one solvent surety in the like amount to the satisfaction of the Trial Court concerned. He shall surrender on 04-09-2023 before the Court concerned under intimation to the Registry of this

Court through his counsel.

Accordingly, I.A. No.15515 of 2023 stands allowed. List this case in the week commencing 04-09-2023 to verify the factum of surrender by appellant Suraj Jatav.
