Heard on I.A. No.18650 of 2023, an application under Section 389(1)

of the Cr.P.C. for suspension of sentence and grant of bail to appellant No.3 - Ram Prasad Yadav and appellant No.4 - Vishal Yadav arising out of judgment dated 13.07.2023 delivered in S.T. No.100117/2016 by First Additional Sessions Judge, Begumganj, Raisen (M.P.).

The appellant Nos.3 and 4 have been convicted under Sections 148, 323 read with Section 149 (six counts) and 325 read with Section 149 (one count) of the I.P.C. and sentenced to undergo R.I. for one year each, S.I. for six months on each count each and R.I. for one year with fine of Rs.500/- each respectively, with default stipulations.

Considering the short sentence coupled with the fact that final hearing of this appeal is not possible in near future, we deem it proper to suspend the remaining jail sentence of these appellants.

Accordingly, I.A. No.18650 of 2023 is allowed. Subject to depositing the fine amount (if not already deposited), the remaining jail sentence of appellant Nos.3 and 4 are hereby suspended and it is directed that appellant No.3 - Ram Prasad Yadav and appellant No.4 - Vishal Yadav be released on bail on their furnishing a personal bond for a Signature Not Verified Signed by: RAJESH KUMAR JYOTISHI Signing time: 8/25/2023 5:22:54 PM

sum of Rs.30,000/- (Rupees Thirty Thousand only) each with one solvent surety each of the like amount to the satisfaction of the trial Court with a further direction to appear before the trial Court, Begumganj, District Raisen on

30 th of October, 2023 and also on such other dates as may be fixed by the trial Court in this regard during the pendency of this appeal.
