The present appeal has been titled as Ist Criminal Appeal under Section 14(A)(2) of the SC/ST Act, 1989.

Counsel for the State submits that earlier also criminal appeal was filed by the appellant and the same was withdrawn with liberty to approach the Trial Court again and infact this is IIIrd Criminal Appeal which is not maintainable in view of the judgment passed by the co-ordinate Bench of this Court at Gwalior in Criminal Appeal No.1502/2023 (Neeraj Vs. State of M.P. and another).

Counsel for the appellant prays for time to address on the question that whether the present appeal shall be treated as Ist appeal or IIIrd appeal.
