Th is petition coming on for hearing this day, th e court passed the
following:
ORDER
1. Through this petition, petitioner is seeking direction to count his past Signature Not Verified Signed by: RASHID KHAN Signing time: 03-08-2023 12:00:17 PM
services rendered by the petitioner w.e.f. 13.11.1987 to 31.12.1996 when he worked as daily wager employee.
2. Learned counsel for the petitioner submitted that the petitioner wants to count his past services for the aforesaid period as daily wage employee and in support of his submissions, he referred the judgment rendered by the Hon'ble Court in the case of State of M.P. Vs. Raisa Begum in Special Leave Petition (Civil) No.(CC4671/2012) delivered on 23.03.2012 and Full Bench decision of this Court in the case of Mamta Shukla Vs. State of M.P. reported in 2011 (3) MPLJ 210. Therefore, counsel for the petitioner seeks parity vis-a-vis order dated 16.01.2013 passed in Writ Petition No.1029/2023 by
the Coordinate Bench of this Court.
3. Learned Government Advocate for the State opposed the prayer.
4. Heard.
5. Considering the above submissions, this petition is disposed of with a direction to the petitioner to file representation alongwith certified copy of this order before the competent authority. In turn, the said competent authority shall consider and decide the same in light of judgments passed by Apex Court and this Court by passing a reasoned and speaking order within a period of three months from the date of passing of this order in accordance law.
6. With the aforesaid directions, the petition stands disposed of.
