The appeal seems to be arguable, hence admitted for final hearing.

Also heard on I.A. No.5901/2023, an application for suspension of sentence and grant of bail to the appellant.

The appellant has been convicted under Section 7 of the Prevention of Corruption Act, 1988 and sentenced to undergo rigorous imprisonment for three years with fine of Rs.10,000/-, under section 13(1)(d), 13(2) of of Prevention of Corruption Act and sentenced to undergo rigorous imprisonment for three years with fine of Rs.10,000/-, under Section 193 of IPC and sentenced to undergo rigorous imprisonment for one year with fine of Rs.5,000/-, under section 196 of IPC and sentenced to undergo rigorous

imprisonment for three years with fine of Rs.5,000/-, under section 213 of IPC and and sentenced to undergo rigorous imprisonment for nine months with fine of Rs.5,000/-, under Section 218 of IPC and sentenced to undergo rigorous imprisonment for three years with fine of Rs.5,000/- and under section 219 of IPC and sentenced to undergo for three years with fine of Rs.10,000/-, with default stipulations.

The appellant remained under custody during the trial for the period of more than two months as reflected from para 69 of the judgment of the trial Court.

Considering the aforesaid and the fact that the final hearing of the matter is going to take a long time, this application is allowed.

Remaining jail sentence of the appellant is hereby suspended and it is directed that subject to depositing the fine amount and furnishing a personal bond in the sum of Rs.50,000/- (Rs. Fifty Thousand Only) with one surety in the like amount to the satisfaction of trial Court concerned, the appellant shall be released on bail with a further direction to appear before the Registry of this Court firstly on 10th October, 2023 , and also on such other dates as may be

fixed by the Registry in this regard during the pendency of this appeal.

I.A. No.5901/2023 stands disposed of.

List for final hearing in due course along with CRA No.3428/2023. Certified copy as per rules.
