Heard on I.A.No.4653/2022, which is an application for condonation of delay in filing the appeal.
It is submitted by learned counsel for the appellant that the impugned judgment and decree was passed during the Corona period but after cessation
of the period for which limitation was excluded by the Hon'ble Supreme Court, the appeal could not be filed by the appellant within time on the misconception that the appeal can be filed only on resumption of the physical hearing. It was hence so filed due to which the delay has occurred which is bonafide.
Though reply to the application has not been filed by the respondents but the application is vehemently opposed on the ground that no sufficient reason has been furnished by the appellant for the delay in filing the appeal.
In my considered opinion, the cause for the delay as shown by the appellant is reasonable and justifiable hence I.A.No.4653/2022 is allowed and
the delay in filing the appeal is condoned.
Record of the Courts below have already been received. Office is hence directed to list the appeal for hearing on the question of admission after six weeks.
