Admit.

I.A. No. 22850 of 2021, an application for change of counsel, is taken up, considered and allowed for the reasons mentioned.

Heard o n I.A. No. 14342 of 2022, first application under Section 389

(1) of CrPC for suspension of jail sentence and grant of bail to appellants No. 1 and 2 - Pappu @ Sartaj and Chand Miya respectively.

This Criminal Appeal assails the judgment dated 01.11.2018 passed by Special Judge, M.P.D.V.P.K. Act, Gwalior (M.P.) in Special Sessions Trial No.32/2014, whereby appellants No. 1 and 2 have been convicted under Section 397 of IPC and have been sentenced to undergo rigorous imprisonment of ten years with fine of Rs.2,000/-, with default stipulation.

Learned counsel for appellants No. 1 and 2 submits that the trial Court has wrongly convicted the appellants without proper appreciation of facts of the

case. He further submits that both the appellants have served more than five years of incarceration out of total jail sentence of ten years i.e. 1/2 of the total jail sentence. Present criminal appeal is likely to take long time to conclude. Hence, prayed to suspend the jail sentence and grant of bail to appellants No. 1 and 2.

Counsel for the State vehemently opposed the application and prayed for its rejection.
