Heard on I.A.No.13837/2022, an application under Section 397(1) of Cr.P.C. for suspension of sentence and grant of bail to the petitioner.

This Criminal revision assails the judgment dated 29.08.2022 passed in

Criminal Appeal No.47/2022 by First Additional Sessions Judge, Datia, whereby the conviction and sentence, as recorded by JMFC, Bhander, District Datia in Criminal Case No.284/2017 vide judgment dated 27.04.2021 have been affirmed. Accordingly, the petitioner stands convicted under Sections 304-A and 337 of IPC and sentenced to undergo R.I. for one year and 3 months and to pay fine of Rs.500/- and Rs.300/- respectively, with default stipulation.

Learned counsel for the petitioner submits that the petitioner has wrongly been convicted. He has suffered 2 1/2 months custody. The fine amount has already been deposited by the petitioner. There is fair chance of success of this

revision. Under these circumstances, petitioner prays that execution of sentence be suspended and the petitioner be released on bail.

On the other hand, State counsel opposed the application and prayed for rejection.

In view of the facts and circumstances of the case, but without expressing any opinion on the merits of the case, the application (I.A. No.13837/2022) is allowed.

It is directed that the petitioner be released on bail on his furnishing a personal bond in the sum of Rs.50,000/- (Rs. Fifty Thousand Only) with one surety in the like amount to the satisfaction of the concerned trial Court. The petitioner shall now appear before the Registry of this Court 14.12.2022 and on all other dates which may be given by the Office for his appearance.
