               It is submitted by the counsel for the petitioner that although, the subject
matter of this petition has already been considered and decided by order dated
14/12/2021 by this Court in the case of Satish Babu Shukla Vs. State of
M.P. (W.P.No.13264/2020) . However, said order is already under challenge

in the writ appeal and direction No.1 has been stayed.
               In the light of the judgment passed by the Supreme Court in the case of
State of Punjab and others Vs. Rafiq Maish (White Washer) and others
reported in (2015) 4 SCC 334, such recovery is not permissible.
               Issue notice to the respondents on payment of process fee by registered

AD as well as ordinary mode. Process fee be paid within three working days.

As an interim measure, it is directed that effect and operation of order dated 04/06/2022 (Annexure P-1) shall remain stayed till the next date of hearing.
