Shri A. Rajeshwar Rao, Govt. Advocate for the State. The short point involved in the present petition as projected by learned counsel for the petitioners is that without affording any opportunity of being
heard, the Trial Court has issued directions for registration of offence against the petitioners in paragraph 79 of the impugned judgment and to the disciplinary authority to take appropriate disciplinary action in paragraph 80.
Learned counsel for this purpose have relied upon decision of the Apex Court in The State of Uttar Pradesh v. Mohammad Naim AIR 1964 SC 703, Om Prakash Chautala v. Kanwar Bhan [2014 (5) SCC 417] and Single Bench decision of this Court in K.P. Singh Kushwaha V. State of M.P. 2005 (2) MPHT 423 : 2005 2 MPLJ 276.
Since the State Counsel is not ready with the arguments today, list next
week on the said short point.
Interim relief to continue till next date of hearing.
