Shri Jugal Kishore Lodhi, Panel Lawyer for the State. Learned counsel for the appellant seeks permission of this Court to withdraw I.A. No.1530/2022-an application for conversion the present criminal appeal into criminal revision.
Permission is granted.
Accordingly, I.A. No.1530/2022 is dismissed as withdrawn. I n view of the provisions of Section 14-A of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act and also having regard to the order dated 03.02.2022 passed by a co-ordinate Bench of this Court in Criminal Appeal No.3588/2021(Guddu @ Vijay & others Vs. State of M.P. & another) and the judgment passed by Hon'ble the Supreme Court in Criminal Appeal No.472/2021 (Sanjay Kumar Rai Vs. State of Uttar Pradesh & Anr. ) on 07.05.2021, the appeal against order framing charge is maintainable.
Therefore, the office objection regarding maintainability of the appeal is
overruled.
As prayed for by learned counsel for the appellant, list the case after two weeks.
Meanwhile, State is directed to serve notice to the victim/complainant under Section 15-A(3) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989 & submit the compliance report and also to make the case diary available on the next date of hearing.
