Learned counsel for the applicant when informed by learned Panel Lawyer that a report dated 30/03/2022 issued by one Veenata Gour, Scientific Officer, ACE, Government of Madhya Pradesh, State Forensic Lab Sagar has given a report pointed that the DNA profile obtained from the virginal
slide and panty of the victim matches with the DNA profile (YSTR) obtained from the blood sample of the accused/Lalesh @ Lavkesh Prasad Mahra, submits that since prosecutrix has turned hostile therefore the cognizance of DNA report cannot be taken.
When he was requested to read provisions of contained in section 53A of the Cr.P.C, then he submits that there are plithora of judgments to support his case, and prays for time to bring them on record.
