4. Shri Thakur submits that as per book namely; Madhya

Pradesh Ek Bhougolok Adhayayan written by Kamal Sharma

correct answer will be both namely Ganga Basin and Yamuna

Basin. Reliance is also placed on the book namely: Bhugol

Ek Samagra Adhayan writer- Mahesh Kumar Barnwal-S.S.P

Pandicheri Police Sewa published by Cosmos Publication.

He submits that when there are two correct answers

namely Ganga Basin and Yamuna Basin, therefore, in terms

of the terms and conditions of the advertisement, where there

is possibility of two answers then marks should be awarded

for both options instead of treating answer given by the

petitioners to be incorrect.

Shri Aditya Pachori, learned counsel for the

respondent/MPPSC has produced report of the expert

committee wherein it is noted that correct answer for the

Question is Yamuna Basin.

In support reliance is placed on the book published by

Madhya Pradesh Hindi Granth Acadamy, Bhopal namely:-

Madhya Pradesh : Ek Bhougolik Adhyayan by Late Dr.

Pramila Kumar and Dr. Shrikamal Sharma, 19 th Edition

(Revised and updated) 2015 wherein on page 65 under the

title Jal Sanshadhan Avam Shichiye in table 6.1 is extracted

giving details of availability of surface water on the basis of

different basins. It is evident that in Ganga Basin only two

rivers have been shown namely Tones and Son. Wherein in

Yamuna Basin eight (8) rivers are there namely; Ken, Kawari

Chambal, Jamani, Pesuni, Betwa, Dhasan and Began

Thus, the authenticate material from the Madhya

Pradesh Hindi Granth Acadamy, Bhopal namely:- Madhya

Pradesh, is taken into consideration and it is submitted that

correct answer to the question is 'Yamuna Basin' and not

'Ganga Basin'.

Learned counsel for respondent has placed reliance on

Full Bench judgment of this High Court in the case of Nitin

Pathak Vs. State of M.P. & others, ILR 2017 MP 2314 :

2017 SCC OnLine MP 1824. In this case Hon'ble Full

Bench has held that in case of recruitment examination, in

exercise of power of judicial review, Court should not refer

the matter to Court appointed expert as the Courts have a

very limited role particularly when no mala fides have been

alleged against the experts constituted to finalize answer key.

It would normally be prudent, wholesome and safe for the

Courts to leave the decisions to the academicians and experts.

Shri Thakur submits that as per book namely Madhya

Similarly reliance is placed on book namely Bhugol Ek

Samagra Adhyayan by Mahesh Kumar Barnwal published by

Cosmos publication in October, 2019 wherein on page 20 of

is mentioned as under:-

Reliance is also placed on book by National Council of

Educational Research &Training (N.C.E.R.T) for class 11 th

title Bharat Bhoutik Prayawaran in which under Chapter 3

Drainage System, it is mentioned as under:-

In view of the fact that book published by M.P Hindi

Granth Academy Bhopal on which petitioner has placed

reliance, in table 2.1 itself it is categorically mentioned as

under:-

In book "Bhugol Ek Samagra Adhayan" by Cosmos

Publication, it is mentioned that Yamuna meets Ganga from

right hand side in Ganga at Prayag (Allahabad). It is further

mentioned that Chambal, Sind, Betwa, Ken and Tones meet

Yamuna (Page 22).

In the book Madhya Pradesh, Bharat Evam Vishwa Ka

Bhogoul Tatha Prayavaran-Paristithiki" by Drishit

Publication, it is mentioned under the Chapter 'Drainage

System' that on the right bank of Yamuna, Chambal, Sind,

Betwa and Ken meets it.

In the book "Bharat ka Bhugol' by Majid Hussain

published by McGraw Hill Education, 9 th Edition, in Chapter

'Drainage' page 3.16 it is mentioned that ";equk dh vf/kdrj

eq[; lgk;d ufn;ka nkfguh fn'kk ls vkdj feyrh gSaA lgk;d vf/kdrj

ufn;k¡ foa/;u ioZr ls fudydj ;equk unh esa feyrh gSaA pEcy] fla/k] csrok]

dksu rFkk Vksal ufn;k¡ fo/;u Js.kh ls fudydj ;equk unh esa vkdj feyrh

gSaA".

Even N.C.E.R.T book for class 11 th title "Bharat

Bhoutik Prayawaran" makes a mention that " izk;}hi ds mRrjh

Hkkx esa fudyus okyh pacy] fla/k] csrok] dsu o lksu ufn;k¡ xaxk unh ra=

dk vax gSaA". Meaning that Chambal is part of 'Ganga River

System'. It does not say that Chambal is part of "Ganga Basin

Drainage System'. Thus reliance on N.C.E.R.T book is also

misplaced.

Further taking into consideration the law laid down in

case of Nitin Pathak Vs. State of M.P. & others (supra) and

Hon'ble Full Bench of this Court having reference to the

judgment of Hon'ble Supreme Court in the case of H.P.

Public Service Commission Vs. Mukesh Thakur, (2010) 6

SCC 759 so also judgment of Karnataka High Court in the

case of Dr. Praveen Kumar I. Kusubi Vs. Rajiv Gandhi

University of Health Sciences), (2004) 3 Kant LJ 218, it is

evident that Hon'ble Supreme Court in the case of Mukesh

Thakur(supra) has held that Court cannot take upon itself

task of examiner or selection board and examine

discrepancies and inconsistencies in question papers and

evaluation thereof.

And even in the narration it is clearly mentioned that

Chambal is the part of the Drainage System of Jamuna. I have

no hesitation to hold that report of the expert committee

cannot be faulted with on the basis of certain flawed or

incorrect publications and report of the Expert Committee is

to be accepted in the light of law laid down above, no

indulgence is required. Petitioner will be free to sue them for

damages in appropriate proceedings. Petition fails and is

dismissed.
