This appeal was admitted on 13.01.2022 and execution of judgment and decree passed by District Judge Jabalpur in Civil Appeal No.5A/2009 was stayed. Although reply of application under Order 39 Rule 1 and 2 CPC has been filed on behalf of respondent Nos.1 and 3, but nobody is there to press

the same, therefore, both the IAs (IA No.7633/2015 and IA No.8474/2021) are closed with the direction that the interim order granted on 13.01.2022 shall remain in operation till the decision of present second appeal.

I.A. No.8825/2021, application under Order 41 Rule 27 CPC shall be considered at the time of final hearing.

In the meantime respondents are free to file reply.

List the case for final hearing in due course.
