Heard on I.A.No.8224/2020, which is an application for condonation of delay in filing the appeal Appeal is barred by 107 days.
Learned counsel for the appellant submits that appellant was in custody at the time of delivery of judgment and his sister-in-law hardly arranged the expenses for filing this appeal, due to which the delay has been caused.
The application is supported by an affidavit. Learned counsel for the respondent/State has objected the prayer as day-to-day delay has not been explained by the appellant.
Considering the fact that appellant was in custody prior to the impugned judgment, therefore, after due consideration I.A.is allowed and the delay is condoned.
Also heard on I.A.No.28190/2021, an application for connecting Cr.A.No.2644/2021 and Cr.A.No.2651/2021 with the present appeal, as all the appeals arising out of same transaction.
Learned counsel for the respondent/State has no objection. After due consideration I.A.is allowed. Let this appeal be connected with Cr.A.No.2644/2021 and Cr.A.No.2651/2021.
