The High Court Of Madhya Pradesh WP No. 25123 of 2021 (RAMLAL Vs THE STATE OF MADHYA PRADESH AND OTHERS)

Indore, Dated : 12-01-2022 Heard through Video Conferencing.

Ms.Sumanlata Tamrakar, learned counsel for the Petitioner. The petitioner has filed the present petition in the nature of public interest seeking restoration of possession of the Collector for the management of Shriram temple situated at Gram Badi Dehandi.

According to the petitioner, Ramesh s/o Tolaram Bairagi approached

the civil Court Petlawad claiming himself to be the owner of the Shriram temple and its own land on the basis of forged documents. According to the petitioner, the temple was renovated and upgraded by the villagers. Ramesh Tolaram is a retired Teacher and not residing in the village. The worship is being carried out by Shabudas since last 40 years. The civil Court has divided the temple and land 1/2 1/2 between Ramesh and Shabudas. The petitioner and other villagers made a complaint to the Collector for the removal of the Pujani and recording the name of Collector as Administrator.

According to the petitioner, there is already a decree in respect of the

temple and its land, passed by the civil Court Senior Devision, Petlawad and in the execution proceeding an order has been passed which is filed as Annexure P/1. The matter is pending before the civil Court, therefore, if the petitioner is having any grievance in respect of that judgment and decree he can avail the remedy available under the law but such a dispute cannot be examined or entertained in a writ petition filed in the nature of Public Interest Litigation.

No case for interference is made out. The petition is dismissed.
