No one appears on behalf of respondent No.2 even in the second round.
Heard on I.A.No.25833/2021, an application for staying the conviction awarded to the appellant/husband by the impugned judgment dated 29/06/2015 passed by learned ASJ, Gwalior in ST No.141/2012.
It is submitted on behalf of the appellant that this matter relates to dispute between the husband and wife and the present appellant is a government servant (Professor). On account of dispute between the husband and wife a false complaint has been lodged against the appellant. The learned trial Court has wrongly taken cognizance of the matter and issued summons for appearance of the appellant.
Considering the reasons assigned in the application, in the meanwhile, it is directed that the effect and operation of the impugned order dated 29/06/2015 passed in ST No.141/2012 in regard to conviction of the appellant is hereby stayed until further orders.
List this case along-with Cr.R.No.64/2017. C.C. as per rules.
