Counsel appearing for the appellant has filed I.A. No. 611/2021 for condonation of the delay.
It is submitted by the counsel for the appellant that as per the judgment of Apex Court passed in M.A. No. 665/2021, there is no delay in filing of
arbitration appeal. Period of lockdown is not to be taken into consideration for counting the time of limitation. In view of same, arbitration appeal may be heard on its merits.
Registry has not given any report whether there is any delay or not in filing of arbitration appeal. Matter is sent beck to Registry for calculating the delay and giving its report whether there is any delay in filing arbitration appeal, after considering the judgment passed by the Apex Court, mentioned above.
List the matter in next week for consideration.
