                  Present appeal is admitted for hearing on the following
            substantial questions of law :
                          1.     Whether the learned lower appellate courts
                   has committed an error partly dismissing suit of the
                   appellant/plaintiff on the ground of readiness and
                   willingness contrary to the pleading and evidence and
                   therefore perverse ?
                          2. Whether the learned courts below have
                   committed an error in passing impugned judgment and
                   decree contrary to pleading and evidence, therefore
                   perverse ?
                  Let notice be issued to the respondent/s on payment of PF

within seven days; returnable within eight weeks.
