Shri Rohit Shrivastava, learned Panel Lawyer for the respondents-State.
Petitioner styling himself a doctor is before this Court seeking security at Kaya Hospital, Gwalior (M.P.) having threat perception to his life and property.
Counsel for the respondent-State on advance notice submits that in case petitioner has apprehension of the nature as canvassed in the writ petition, he is
always free to make complaint to the concerned Police Station in criminal procedure and there is no reason why the said complaint shall not be adverted to and for reason he seeks security personnel, he may also apply and on usual charges, he may process the same as well.
In view of the aforesaid statement made at the Bar, petitioner is set at liberty to approach the concerned Police Station and also respondent No.3- Superintendnet of Police, Gwalior with the complaint and seek indulgence in the light of judgment of Hon'ble Supreme Court in Lata Singh v. State of U.P. and Another, (2006) 5 SCC 475.
It is made clear that this Court has not expressed any opinion on the merits of the case.
