Shri K.S.Tomar, learned counsel for the State.
It is submitted by the counsel for the appellant No.2 that the
appellant No.2 has surrendered on 11/02/2022. The certified copy of
the said order has been supplied to the Court. The same is taken on
record.
It is submitted by the counsel for the appellant No.2 that
although, the judgment in question was passed on 27/11/2021, but
since, the mother of the appellant No.2 was not well, therefore, he did
not surrender. However, it is fairly conceded that the appellant No.2
had come to Gwalior alongwith his mother for filing of this appeal.
So far as the bonafides of the appellant No.2 is not surrendering
before the Trial Court on the day when the judgment was pronounced,
it is suffice to mention that no documents have been filed to show that
the mother of the appellant No.2 was seriously ill.
Accordingly, Shri Goswami prays for and is granted two days'
time to file the medical certificates of the mother of the appellant No.2
to show that she was seriously ill and was having treatment.
