This criminal appeal under Section 374 of CrPC has been filed

against the judgment and sentence dated 21.05.2018 passed by First

Additional Sessions Judge, Mungawali District Ashoknagar in S.T.

No.20/2015, by which the appellant has been convicted under Section

8 of POCSO Act and has been sentenced to undergo rigorous

imprisonment of three years and a fine of Rs.1,000/-.

Initially a PUD dated 09.11.2021 was received from the Court

of CJM, Ashoknagar to the effect that the sole appellant Amar Singh is

not appearing before the Trial Court. Later on, another PUD dated

29.01.2022 has been received from the office of CJM, Ashoknagar to

the effect that the sole appellant Amar Singh has expired on

23.07.2021 in a vehicular accident. Copy of death certificate of Amar

Singh has also been placed on record.

In view of the PUD dated 29.01.2022, it is clear that the

appellant Amar Singh has expired. Accordingly, this appeal is

dismissed as abated.
