The High Court Of Madhya Pradesh CRA No. 215 of 2009 (NARENDRA SINGH Vs MOHM.SAKIR KHAN)

Gwalior, Dated : 21-02-2022 Shri Yogesh Singhal, learned counsel for the appellant.

The present appeal under Section 374 of the Code of Criminal Procedure against the order dated 04.07.2008, whereby the trial court has dismissed the complaint because cheque was issued as security to the complainant.

Vide judgment dated 27.02.2020, this Court allowed the appeal and disposed of with certain directions as referred in para 10 of the judgment. Due to

inadvertence, cause title of appeal was referred as Narendra Singh Vs. State of Madhya Pradesh whereas correct cause title is Narendra Singh Vs. Mohammad Sakir Khan.

It appears that due to such error in cause title, case could not be proceeded further. Office note dated 18.03.2020 indicates such anomaly. The aforesaid typographical error appears to be bona fide in nature.

On due consideration, office note is taken care of and cause title of Criminal Appeal No.215/2009 stands corrected with correct cause title as Narendra Singh Vs. Mohammad Sakir Khan.

Trial Court is directed to proceed as per judgment dated 27.02.2020 against Mohammad Sakir Khan. For all legal / practical purpose, cause title stands as Narendra Singh Vs. Mohammad Sakir Khan wherein Sakir Khan is accused.

Copy of this court shall be kept in the record of Cr.A. No.215/2009 and this order shall be read in conjunction with the judgment dated 27.02.2020.

Trial Court be informed accordingly while sending a copy of this order for necessary consequential follow up action.

Disposed of accordingly.
