Heard on admission.
The grievance of the petitioners/decree holders is that their application has
been rejected by the trial Court whereby going contrary to the decree passed by
trial Court and affirmed up to second appeal stage, mesne profits are confined to
decision of second appeal and not till possession is given. Recently possession
has been given to the petitioners as decree holder by respondents/defendants /
judgment debtors but that aspect has not been considered in correct perspective by trial Court.
Issue notice to the respondents by RAD post on payment of process fee within seven working days. Notice be made returnable within four weeks.
