petitioner.

respondent/State.

Petitioner serving as Gram Panchayat Secretary of Gram Panchayat Kemkheda, Janpad Panchayat Pichhor, District Shivpuri, has approached this Court taking exception to his transfer order dated 31.08.2021 (Annexure P/1) transferring him from Gram Panchayat Kemkheda, Janpad Panchayat Pichhor, to Gram Panchayat Panwariukawal, Janpad Panchayat Kolaras, District Shivpuri, alleging that the transfer is illegal and contrary to transfer policy.

During the course of hearing, it is transpired that the petitioner has approached the authority through a representation (Annexure P/4).

In view of aforesaid, this Court refrains from commenting upon the contentions advanced, and relegate the petitioner to approach the respondent No.2 along with copy of the order passed today, for early disposal of his pending representation, provided that the petitioner has joined first at the transferred place, in the light of the judgment reported in ILR (2015) MP 2556 (Mridul Kumar Sharma vs. State of MP & Ors.).

This Court hopes and trusts that the respondents shall look into the grievance of the petitioner and address thereupon in accordance with law, expeditiously.

With the aforesaid, writ petition stands disposed of. It is made clear that this Court has not expressed any opinion on the merits of the case.
