Heard on the question of admission. Learned counsel for the appellant placed reliance upon the judgment of Hon'ble the Apex Court in the case of Bayanabai Kaware Vs. Rajendra reported in (2018) 1 SCC 585.

This second appeal is admitted for final hearing on the following substantial questions of law:-

"(a) Whether the learned first appellate Court has committed error in deciding new factual questions without framing issues and without receiving evidence on it after reversing the finding of learned Civil Court?

(c) Whether the learned trial Court has erred in interpreting Section 68 of the Indian Evidence Act?"
