This appeal under section 13 of Hindu Marriage Act, 1955 is at the instance of wife against the judgment dated 16.1.2019 passed in RCSHM/117/2017. The petition for divorce under section 13 (1) (iA) of the Hindu Marriage Act, 1955 has been dismissed.

In terms of the order passed on 6.4.2022 both parties are present with their respective counsels. During the course of the hearing it has transpired that marriage solemnized between the two on 7.5.2004 did not run smoothly. Both of them started living separately since 2017.

Looking to the demeanor of the parties we have noticed that love is lost and emotions are dried up between the two. It appears to be an irretrievable marriage. Both of them have made a joint prayer that they may be allowed to live separately dissolving their marriage.

Let both the parties appear before this Court again on 26th April, 2022 for

filing joint application under section 13-B of Hindu Marriage Act, 1955 with affidavits and also for recording their statements before the Principal Registrar of this Bench.

List the matter on 26th April, 2022.
