On the perusal of the assertion made in the writ petition, it is clear that the controversy in this case is covered by the decision rendered by the

Tribunal in Original Application No.2745/1989 (Madhukant Yadu and others Vs. State of M.P. and others ) decided on 24.8.1992. The said judgment has been affirmed by the Apex Court in the Special Leave to Appeal Civil No.(1) 6892/1993.

In view of the aforesaid, I am inclined to direct that if the petitioner make a representation to the respondent authorities annexing the order passed by the Tribunal as well as by the Apex Court indicating that he is covered, the said authority shall take a decision in that regard within a period of three months from the date of submission of said representation.

The writ petition is accordingly disposed of. There shall be no order as to costs.
