On perusal of the assertions made in the writ petition, it is clear that the controversy in this case is covered by the decision rendered by the Tribunal in Original Application No.2745/89 (Madhukant Yadu and others Vs. State of M.P. and others) decided on 24.08.1992. The said judgment has been affirmed by the Apex Court in Special Leave to Appeal Civil No.(1) 6892/1993.
In view of the aforesaid, I am inclined to direct that if the petitioners make a representation within 15 days to the respondent No.1 annexing the order passed by the Tribunal as well as by the Apex Court indicating that they are covered, the said authority shall take a decision in that regard within a period of 30 days from the date of submissions of said representation.
The writ petition is accordingly disposed of. There shall be no order as to cost.
