Shri Praveen Newaskar, learned counsel for appellant/CBI.
IA 25842/21 has been filed for granting permission to file criminal
appeal.
Learned counsel for CBI in support of IA 25842/21 inter alia points
out to Paragraphs 26 to 32 of the impugned judgment to contend that once
the respondents who have found guilty of the offence punishable u/S.419 IPC
and sentenced to two years R.I. with fine of Rs.1000/- then the same court in Paragraph 32 could have neither cancelled the said sentence nor converted the same into simple imprisonment till rising of the Court with fine of Rs.5000/-.
The ground raised in this appeal appears to be arguable and therefore, prayer sought in IA 25842/21 is granted.
IA 25842/21 stands allowed.
Let bailable warrant be issued against the respondents in sum of Rs.25,000/- (Rs. Twenty Five Thousand Only) each to secure their
appearance before this Court on a date to be fixed by the Registry.
List on the said date so fixed by the Registry.
