Matter was mentioned before this Court on the ground that on 05.02.2020 an interim relief was granted by this Court and further proceedings

of Civil Suit No.107-A/2015 pending before the First Civil Judge Class-I, Patan District Jabalpur was stayed, till the next date of hearing. However, as the matter could not be listed on subsequent dates, the Trial Court has started proceeding in the matter considering the judgment passed by the Hon'ble Supreme Court in the case of Asian Resurfacing of Road Agency P.Ltd. and another Vs. Central Bureau of Investigation reported in (2018) 16 SCC 299 wherein a direction was given by the Hon'ble Supreme Court that the stay granted by this Court shall continue for a period of six months until and unless it is subsequently continued. It is submitted that as the matter

could not be listed for hearing despite best efforts being made by the petitioner, the Trial Court has started proceeding into the matter, therefore, he has filed an application being I.A.No.9540/2021 an application for extension of interim order dated 05.02.2020.

He has stated at Bar that he has already informed the respondent's counsel regarding mentioning of the matter today for consideration of this application. However, when the matter was taken up nobody has appeared on behalf the respondents.

In such circumstances, this Court deems it appropriate to extend the interim relief granted to the petitioner on 05.02.2020, till the next date of hearing.

Matter is directed to be listed in the week commencing 04.10.2021 2 WP-17737-2019 for further consideration.
