In the present petition, petitioner is seeking following relief :-

"In view of the facts and circumstances of the case, it will be just and proper that this Hon'ble Court may kindly be pleased to issue an interim direction to the respondent no.4 to consider and decide the representation (Annexure P/8) expeditiously in the light of order dated 15.05.2018 passed in W.P.No.461/2018, in the interest of justice." It is stated that the issue involved in the present petition is res integra and has been concluded and decided by the co-ordinate Bench of this Court in the case of Gendalal and Ors. Vs. State of M.P. & Ors. on 16.05.2018 passed in W.P.No.461/2018.

Considering the earlier judgment passed in the case of Teju Lal Yadav Vs. State of Madhya Pradesh and ors. reported in ILR (2009) MP 1326 and also considering the case of K.L.Asre Vs. State of M.P. decided on 07.11.2005 passed in W.P.No.1070/2003.

It is argued that a detailed representation has already been submitted by the petitioner to respondent authorities and the same is kept pending for consideration and not yet decided till date.

In such circumstances, an innocuous prayer is made to direct the District Education Officer to consider grievance of the petitioner and decide his representation within a stipulated time frame.

P er contra, State counsel has no objection to the innocuous prayer made by the petitioner.

of certified copy of this order and communicate the outcome to the petitioner.

Needless to mention that this Court has not expressed any opinion on the merits of the case.

With the aforesaid observations, this petition is disposed of. Certified copy as per rules.
