Heard on I.A.No.3472/2021, an application under Order 23

Rule 1 of C.P.C.

By this application permission has been sought to withdraw the

appeal.

For the reasons mentioned in the application, the same is

allowed.

Accordingly, the appeal is dismissed as withdrawn.

Since, the parties have settled down their matter out of Court

therefore, in the light of judgment passed by the Supreme Court in the

case of The High Court of Judicature at Madras Rep. by its

Registrar General Vs. M.C. Subramaniam and others passed on

17/02/2021 in SLP (C) Nos.3063-3064 of 2021, the Court fee paid by

the appellant is refundable. Accordingly, if the appellant makes an

application before the Principal Registrar of this Court, then he shall

take necessary action for the refund of the Court fee.
