This first application under Section 439 of CrPC has been filed

for grant of bail.

The applicant has been arrested on 29.06.2021 in connection

with Crime No.62/2021 registered at Police Station Umari Distt.

Bhind for the offence under Sections 307, 294, 506, 34 of IPC and

Section 25, 27 of Arms Act.

It is submitted by the counsel for the applicant that according

to the prosecution case, gunshots were fired on the complainant but

he succeeded in escaping unhurt. It is submitted that the Trial Court

has rejected the bail application mainly on the ground of criminal

antecedents of the applicant, according to which 30 criminal cases

have been registered against him. It is submitted that along with I.A.

No.26416/2021 the applicant has filed copies of some of the

judgments passed in the criminal cases which were registered against

the applicant.

Considered the submissions made by the counsel for the

applicant.

This Court has gone through the copies of the judgments

passed in some of the cases, which were registered against the

applicant, according to which, in one offence, the applicant has been

convicted under Section 307 of IPC and in other cases, he was

acquitted as the witnesses had turned hostile.

Accordingly, this Court is of the considered opinion that either

the applicant has been convicted or the witnesses could not dare to

speak against the applicant.

Accordingly, this application fails and is hereby dismissed.
